1. Acceptance of Terms
By accessing or using PEAK Time Post ("the Service," "we," "us," or "our") at peek-time-post.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and PEAK Time Post. Your continued use of the Service following any changes to these Terms constitutes your acceptance of those changes.
2. Description of Service
PEAK Time Post is an automated video publishing platform designed for hospitality and travel businesses. The Service enables users to:
- Connect multiple TikTok accounts via the official TikTok OAuth 2.0 authorization flow
- Generate short-form hotel property videos using AI-assisted tools and source footage
- Schedule and automatically publish videos to TikTok using TikTok's official Content Posting API v2
- Manage posting queues, video libraries, and account statuses through a unified dashboard
The Service operates as an independent integration with TikTok's official developer platform and APIs. PEAK Time Post is not affiliated with, endorsed by, or sponsored by TikTok, ByteDance Ltd., or any of their subsidiaries.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal authority to agree to these Terms on behalf of yourself or your organization
- Hold valid ownership or management rights to the TikTok accounts you connect
- Comply with TikTok's Terms of Service and Community Guidelines for all connected accounts
- Hold proper rights, licenses, or permissions to all video content you upload and publish
4. Account Registration and TikTok Authorization
To access the core functionality of the Service, you will authorize TikTok accounts through TikTok's official OAuth 2.0 Login Kit. By doing so, you grant PEAK Time Post permission to access the following scopes on your behalf:
- user.info.basic — to identify your TikTok account
- video.publish — to publish video content to your TikTok account
- video.upload — to upload video files via the TikTok Content Posting API
You are responsible for maintaining the confidentiality of any access tokens and for all activity that occurs under your authorized accounts. You may revoke PEAK Time Post's access at any time through your TikTok account settings.
We store OAuth tokens securely and use them solely to provide the Service. Tokens are refreshed automatically before expiration using TikTok's token refresh endpoint. We do not share, sell, or transfer your TikTok access tokens to any third party.
5. Permitted Use and Restrictions
You may use the Service to publish hotel and travel property videos to TikTok accounts you own or have authorization to manage. You agree not to:
- Use the Service to publish content that violates TikTok's Terms of Service or Community Guidelines
- Publish content that infringes on the intellectual property rights of any third party
- Use the Service to publish spam, misleading content, or content designed to artificially inflate engagement metrics
- Attempt to reverse-engineer, decompile, or extract the source code of the Service
- Use automated means to access the Service beyond the features explicitly provided
- Share your access credentials with unauthorized third parties
- Use the Service in any manner that could damage, disable, or impair TikTok's platform
- Publish content depicting minors in inappropriate contexts, illegal activity, or any content prohibited by applicable law
6. User Content and Intellectual Property
You retain all ownership rights to the video content, footage, images, and materials you upload to the Service ("User Content"). By uploading User Content, you grant PEAK Time Post a limited, non-exclusive, royalty-free license to store, process, and transmit your User Content solely to provide the Service.
You represent and warrant that:
- You own or have obtained all necessary rights, licenses, and permissions for your User Content
- Your User Content does not infringe any third-party intellectual property rights
- Your User Content complies with all applicable laws and TikTok's policies
- You have obtained consent from all identifiable individuals appearing in your User Content
PEAK Time Post's platform, codebase, dashboard design, and documentation are the intellectual property of PEAK Time Post and are protected by applicable copyright and intellectual property laws.
7. TikTok Platform Compliance
The Service uses TikTok's official developer APIs. Your use of the Service is subject to TikTok's Terms of Service, Community Guidelines, and API Terms of Service, in addition to these Terms. TikTok's policies take precedence over these Terms with respect to content published on TikTok.
PEAK Time Post makes no guarantee regarding TikTok's API availability, rate limits, or feature set. Changes to TikTok's API may affect the functionality of the Service, and we are not liable for any disruption caused by TikTok's platform changes, downtime, or policy updates.
You are solely responsible for ensuring that content published through the Service complies with TikTok's current Community Guidelines, including rules regarding AI-generated content disclosure, location tagging, and scheduling policies.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Videos published through the Service will reach any particular audience or achieve any specific engagement metrics
- The Service will be compatible with all future versions of TikTok's platform or APIs
- Any errors in the Service will be corrected within any particular timeframe
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEEK TIME POST AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
In no event shall PEAK Time Post's total liability to you for all claims exceed the amount paid by you for the Service in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if continued access would harm the Service, TikTok's platform, or other users.
You may discontinue use of the Service at any time. Upon termination, you should revoke PEAK Time Post's access through your TikTok account settings. Sections covering intellectual property, disclaimer of warranties, limitation of liability, and governing law survive termination.
12. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically. If you disagree with any revised Terms, you must discontinue use of the Service.
